Terms of Service

01 — Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services on your own behalf. A parent or legal guardian may use the Services on behalf of a minor and is responsible for the minor's use. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization.

02 — Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You will not: provide false or misleading information; submit another person's personal information without authorization; use automated means to access, scrape, or submit information to the Services; interfere with the operation or security of the Services; or misrepresent your affiliation with GPA or your certification status.

GPA may suspend or restrict access to the Services for any violation of these Terms.

03 — Inquiries, Applications, and Waitlists

Submitting a form, inquiry, application, or waitlist request does not create a contract, reserve a place, or guarantee acceptance into any program. GPA reviews applications at its discretion and may accept, decline, or request additional information. Features described as "coming soon" are statements of intent and may change or may not launch.

04 — Certification, Membership, and Programs

GPA offers coach certification at three levels, an annual membership, continuing education, mentorship, educator and ambassador programs, and partnerships with organizations (collectively, "Programs"). Certain Programs may be governed by additional written terms provided at enrollment ("Program Terms"). If Program Terms conflict with these Terms, the Program Terms control for that Program.

A GPA certification confirms that the holder met GPA's assessment criteria for that level at the time of assessment. It is personal and non-transferable, may be subject to continuing-education or renewal requirements, and does not guarantee employment, income, or recognition by any third party. Certified coaches may describe their certification accurately and use GPA-issued credentials in accordance with GPA's guidelines.

05 — Fees and Payments

The Services do not currently display pricing or process payments. Where a Program carries a fee, GPA will communicate the fee and the applicable enrollment, renewal, cancellation, and refund terms in writing before payment is requested. Nothing in these Terms limits rights you may have under applicable consumer-protection law.

06 — Coach Conduct

Participants in GPA Programs agree to coach and conduct themselves in a safe, ethical, and professional manner; to prioritize the welfare of players, including minors; to comply with applicable laws, venue rules, and governing-body requirements; and to adhere to any GPA Code of Conduct or safeguarding policy that GPA publishes.

GPA may suspend or revoke a certification, membership, or program participation for violation of these standards, for misrepresentation, or for conduct that raises a safeguarding or safety concern. GPA does not supervise, employ, or control individual coaches and is not a party to the relationship between a coach and the coach's players or clients.

07 — Intellectual Property

The Services and all related content — including the GPA name and logos, curriculum, course materials, assessment criteria, and website content — are owned by GPA or its licensors and are protected by intellectual property laws. GPA grants you a limited, non-exclusive, revocable license to access the Services and to use Program materials for your own coaching and professional development. You may not copy, distribute, sell, modify, or create derivative works from GPA content, or use it to develop a competing program, without GPA's written permission. Certification or membership does not transfer any ownership of GPA content.

By submitting content or information to GPA, you grant GPA a non-exclusive, royalty-free license to use it for the purposes of providing the Services.

08 — Third-Party Services

The Services may contain links to or integrations with third-party websites and services. GPA does not control and is not responsible for third-party content, products, services, or practices.

09 — Disclaimers

Pickleball coaching and play involve physical activity and an inherent risk of injury. GPA provides education, standards, and community; it does not deliver or supervise coaching sessions and does not assess any individual's fitness to play or coach.

To the fullest extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

10 — Limitation of Liability

To the fullest extent permitted by law, GPA and its members, managers, officers, employees, contractors, educators, mentors, ambassadors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Services or these Terms. GPA's total aggregate liability for all claims arising out of or relating to the Services or these Terms will not exceed the greater of the amount you paid to GPA in the twelve months preceding the claim or USD 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11 — Indemnification

You agree to indemnify and hold harmless GPA and its members, managers, officers, employees, contractors, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your coaching activities, your violation of any law or third-party right, or any information you submit to GPA, except to the extent caused by GPA's own negligence or willful misconduct.

12 — Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Massachusetts, and you consent to the jurisdiction of those courts. Nothing in this Section deprives you of protections available under the mandatory consumer-protection laws of your jurisdiction.

13 — General

These Terms, together with the Privacy Policy, Cookie Policy, and any applicable Program Terms, constitute the entire agreement between you and GPA regarding the Services. If any provision is held unenforceable, the remaining provisions remain in effect. GPA's failure to enforce any provision is not a waiver. You may not assign these Terms without GPA's consent; GPA may assign them to a successor or affiliate.

14 — Changes to These Terms

GPA may amend these Terms from time to time. Any revised Terms will be posted with an updated "Last Updated" date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms. Where required by law, GPA will provide additional notice of material changes.
